The dispute stems from an earlier circular by Zuventus allegedly accusing Zorvia of market sabotage
Zorvia Healthcare Limited opposed an adjournment request filed by Emcure Pharmaceuticals Limited, its subsidiary Zuventus Healthcare Limited, and four senior officials in an ongoing criminal defamation case before the Judicial Magistrate First Class (JMFC), Thane.
During the hearing, Zorvia’s legal counsel also flagged concerns over the alleged non-disclosure of financial losses by Emcure under Securities and Exchange Board of India (SEBI) regulations, even as the company has claimed significant losses in multiple legal proceedings against Zorvia.
The dispute stems from a circular Zuventus issued on January 16, 2026, addressed to stockists, distributors, and trade associations, which allegedly accused Zorvia of market sabotage and misuse of Zuventus’ goodwill. Similar allegations were subsequently reiterated in a media report dated January 20, 2026.
Zorvia denied all allegations, asserting it never issued any communication concerning Zuventus’ operations. The company claims the circular deliberately targeted key trade stakeholders to harm its reputation and disrupt its market entry.
Following this, Zorvia filed a criminal defamation complaint under Sections 356(1) and 356(2) of the Bharatiya Nyaya Sanhita before the JMFC, Thane. The court issued notices to the accused, who entered appearance on February 17, 2026.
At the latest hearing on April 17, the accused sought an adjournment citing a writ petition filed before the Bombay High Court challenging the issuance of notice in the case.
Opposing the adjournment, Zorvia’s lawyers argued that the accused had appeared over 60 days ago but had not taken substantive steps in the proceedings; the grounds cited in the writ petition, particularly regarding alleged non-recording of the complainant’s verification were factually incorrect, as verification had already been recorded before a court officer; and although the writ petition was reportedly filed on April 10, it was only registered on the day of the hearing, with no notice issued and no stay granted by the High Court.
Zorvia further contended that while Emcure and Zuventus have claimed substantial financial losses due to Zorvia’s actions in various proceedings, no corresponding disclosures have been made under SEBI (Listing Obligations and Disclosure Requirements) Regulations, 2015, raising questions over the consistency of such claims.
After hearing both sides, the court acknowledged the adjournment application but granted the accused a final opportunity of 10 days to file their reply. The matter has been adjourned to April 29, 2026.
