APHI welcomes CCI order on integrated healthcare delivery model

The ruling brings closure to a nearly decade-long investigation into hospital operations and healthcare delivery practices


Association of Healthcare Providers of India (AHPI) has welcomed the recent order issued by the Competition Commission of India (CCI), which concluded proceedings related to healthcare delivery practices under competition law and recognised the integrated nature of super-speciality healthcare services.

In its order dated May 21, 2026, the CCI rejected the proposition that hospitals function as isolated “aftermarkets” once patients are admitted and acknowledged that super-speciality healthcare operates as a coordinated and integrated care delivery ecosystem.

The ruling brings closure to a nearly decade-long investigation into hospital operations and healthcare delivery practices.

The Commission observed that hospitals provide patients with comprehensive pre-admission cost estimates covering procedures, medicines, diagnostics, and room charges, thereby enabling informed decision-making, comparison among providers, and access to second opinions.

It also noted that patients retain freedom of choice and are not subject to structural or operational lock-ins.

Further, the CCI recognised that hospital pricing reflects significant investments in clinical infrastructure, specialised medical personnel, emergency preparedness, diagnostics capability, inventory management, and continuity of care. 

The Commission additionally noted compliance with applicable statutory pricing frameworks, including Maximum Retail Price (MRP) regulations and relevant price ceilings prescribed by the National Pharmaceutical Pricing Authority(NPPA).

It stated that procurement efficiencies do not legally mandate hospitals to directly transfer wholesale discounts to patients. 

Dr Girdhar Gyani, Director General, AHPI, said, “The CCI appears to have taken a nuanced position. It rejected the idea that every hospital becomes a separate “aftermarket monopoly” over admitted patients, mainly because patients usually have a choice before admission and can compare hospitals, packages, reputation, doctors, and estimated costs.”
